BY USING OUR WEB APP/MOBILE APP YOU AGREE TO THESE TERMS – PLEASE READ CAREFULLY

Introduction

These Terms of Use for all Users govern your use of PPV Messages and your agreement with us. PPV Messages is the simplest way to send your locked digital files with pay-per-view.

Guide to Terms of Service

We refer to our web app/mobile app as “PPV Messages”, including when accessed via the URL www.ppvmessages.com or from GooglePlay or Appstore..

References to “we”, “our”, “us” are references to the PPV Messages app

App/Application means an internet presentation which is operated by the Operator and available online. In particular, to conduct Communication between each other using the Device.

Transfer link means a paid link for viewing digital content through the Application, using the Device.

Content means any material uploaded to PPV Messages or submitted to PPV Messages by any User, including any text, photos, videos, audio, emoticons, GIFs, and any other material (digital files).

Creator – Sender of the message means a User who has set up their PPV Messages account to submit or send Content to PPV Messages for other Users to view.

Payments payments made by fans to view content with a pay-per-view author

Tips means payments made by a Fan to a Creator by way of a tip for a Creator.

Credit means virtual currency that fans buy and exchange for chatting or sending tips.

Commission means a certain portion of Credits paid as remuneration to which the Operator is entitled, in particular, based on the Provision of: (i) Chat communication; (ii) file sharing (iii) Gift; (iv) Post viewing; (v) communication via Messages and/or (vi) Subscription services.

Fan – Recipient of the message means a User who follows the Creator. The fan or recipient of the message can view the Creator’s Content after payment.

User means any PPV Messages user, whether a Creator or fan or both.

Unlock message the user can unlock message (locked link) after paying the amount set by the creator

App means PPV Messages Web App or Mobile App

Changes to the terms

We may revise these Terms at any time to a reasonable extent by editing this page, and you agree to be bound by such revisions.

Ability to use our app

You represent that you are at least 18 years of age or the age of maturity in the jurisdiction from which you are accessing our Application, and that you are fully able and competent to enter into the terms, covenants, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms. If you are under 18 years of age or the applicable maturity age, you are not permitted to submit personal information to us or use our Application.

We have the right to suspend or cancel your account.

We may, but are not obligated to, moderate or review any of your content to verify compliance with the Terms of Service.

It is our policy to suspend access to any content you post or send through the Application that we learn may not comply with the Terms of Service and/or any applicable law.

Registered user

You can become a registered user of our application. You cannot access the content of our application without being a registered user.

PPV Messages file sharing

PPV Messages file sharing allows you to share your Content with others.

To share your Content, you need to upload it to our servers and provide us with your e-mail address and other personal details.

PPV Messages file sharing provides the option to share Content up to a maximum total capacity. Uploaded Content is stored and available to download on PPV Messages servers for a limited period of time and will then expire automatically.

After uploading content, you can set your own price per message view and generate a private transfer link. You can share your link with all messaging apps or social networks.

When the recipient clicks your link, they will see the locked content. After payment, the recipient will see the unlocked content and you get money.

The message recipient (locked link) can make a payment directly by credit card through the Stripe third-party gateway.

After the expiry period, PPV Messages will permanently delete the uploaded files.

About payouts for content creators

Content creator payouts are earnings from PPV Messages and tips from your fans.

We send payments to content creators after reaching the minimum withdrawal limit once a month.

We send payments on the 10th day of the month for the income achieved in the previous month.

Payments may take seven business days or longer to be credited to your bank account.

We send earnings to content creators directly to a bank account or use third-party services (Wise, Stripe or other)

The payee may pay a fee to the bank after receiving money

We do not send payments to countries involved in war conflict, countries with a high rate of internet fraud, or due to banking limitations. We also do not send payments to Bosnia and Herzegovina, Burma/Myanmar, Solomon Islands, Crimea Region, Democratic Republic of Congo, Russia, Cuba, so-called Donetsk People’s Republic (DNR) and Luhansk People’s Republic (LNR), Iran, Iraq, North Korea, Syria, Liberia, Lebanon, Montenegro, Serbia, Sierra Leone, Sudan, Zimbabwe

If you are located in an area where we do not send earnings to content creators from PPV Messages and tips (for example, Crimea), your account will be suspended and earnings will not be paid out.

Upon detection of any illegal activity, your account will be terminated and your earnings will not be sent to you.

We only send USD to other countries

If your country’s currency is not on our list, we can only send you USD.

Promoting tax compliance and VAT

We recommend that all Creators seek professional advice to ensure you are compliant with your local tax and VAT rules, based on your specific circumstances.

Fee for PPV Messages

Our fee for providing the service (file transfer with pay-per-view) is 20% + VAT of the price you set for the message.

We only take the fee for the provision of the service after the sale of your message.

Intellectual property rights

Our App is owned, created, purchased, and licensed by us.

You must not use any part of the content on Our Site for commercial purposes.

PPV Messages does not claim any ownership of the Content you store or share through our Services. You are fully and solely responsible for any such Content. Any responsibility for damages related to the Content is borne by the user who uses, stores, and/or shares it.

You agree to grant us a license to all of your Content to take any action restricted by any intellectual property rights (including copyright) in such Content for any purpose reasonably related to the provision and operation of our Application. Such acts include reproducing, making available and communicating to the public, displaying, performing, distributing, translating and creating adaptations or derivative works of your content, and otherwise dealing with your content.

User – You represent that you own all the intellectual property rights (such as copyrights and trademarks) to your content, or that you have obtained all the necessary rights to your content as necessary to license your content to us and other users.

We are not responsible for

We shall not be liable to any user for any loss or damage, whether related to mutual contractual relationships, breach of statutory duty or otherwise, even if foreseeable, caused or arising in connection with:

Use of, or inability to use, Our App or your Account or Content

We are not responsible for content that is sent in private chat messages.

You agree not to use Our Site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We are not responsible for any loss or damage caused by a virus, distributed denial of service attack, or other technologically harmful material that may infect your devices.

Prohibited uses

You may only use our application for lawful purposes. You must not use our app:

• in any manner that violates any applicable law or regulation,
• for the purpose of harming or attempting to harm people or animals in any way,
• in any manner that is illegal or fraudulent, or has any illegal or fraudulent purpose or effect,
• to reproduce, duplicate, copy, or resell any part of our site, including the source code,
• to upload, post, display, or send content to our App that is illegal, fraudulent, defamatory, hateful, discriminatory, intimidating or harassing, or that incites or promotes violence or any illegal activity,
• to abuse, harm or attempt to abuse or harm a person under the age of 18, for example by exposing them to inappropriate content.

You may not upload, display, promote, advertise, transmit content or link to content that:

• shows, includes or refers to any individual under 18 years old (or which refers to individuals under 18 years old generally)
• shows any other person, unless you have written documentation that all persons depicted or included or referred to in your Content are at least 18 years of age and you have written consent from each individual to use their name or images (or both) in the Content.
•  includes child pornography,
• is obscene, defamatory, libelous, slanderous, profane, indecent, discriminating, threatening, abusive, harmful, lewd, vulgar, or unlawful,
• promotes racism, violence, or hatred,
• promotes weapons or any goods the sale, possession, or use of which is subject to prohibitions or restrictions,
• promotes drugs or drug paraphernalia,
• promotes violence, rape, lack of consent, hypnosis, intoxication, sexual assault, torture, sadomasochistic abuse or hard bondage, extreme fisting, or genital mutilation,
• includes urine or faeces-related material,
• includes necrophilia,
• includes self-harm or suicide,
• includes incest,
• includes bestiality,
• includes sexual content and profanity,
• constitutes “revenge porn” (i.e. any sexually explicit material featuring any individual who has not given prior, express, and fully informed consent to that material (a) being taken, captured, or otherwise memorialised, or (b) being posted and shared on our app),
• promotes escort services, sex trafficking, or prostitution,
• contains, promotes, advertises, or refers to hate speech,
• contains unsolicited sexual content or unsolicited language that sexually objectifies another User or anyone else in a non-consensual way, or contains fake or manipulated sexual content in relation to another User or anyone else,
• contains or refers to anyone else’s personal data or private or confidential information,
• do not use our app to stalk, bully, abuse, harass, threaten, or intimidate anyone else.
• do not do anything that infringes our rights or anyone else’s rights, including intellectual property rights (examples include copyright, trademark, confidential information and goodwill), personality rights, unfair competition, privacy, and data protection rights.

Termination

If you violate these Terms or otherwise cause us risk or potential legal exposure, we may terminate your access to our app or stop providing you with any part of our app without any compensation.
